Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Pebble platform and the pebblearning website (together, the "Service"), operated by Pebble Learning, Ltd. ("Pebble", "we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Who may use the Service
The Service is a professional tool for qualified learning-disability diagnosticians, educators, and the clinics and institutions that employ them. To create an account you must be at least 18 years old and authorised to act on behalf of your organisation.
The Service supports clinical work; it does not provide medical advice and is not a substitute for professional clinical judgment.
Accounts and security
You are responsible for the accuracy of your account information, for keeping your credentials confidential, and for all activity under your account. Notify us promptly of any unauthorised use.
We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security or compliance risk.
Acceptable use
You agree to use the Service only for lawful, professional purposes and in accordance with applicable laws and professional standards.
- Do not upload content you are not authorised to process, or that infringes the rights of others.
- Do not attempt to access data, accounts, or systems that are not yours.
- Do not probe, scan, or test the vulnerability of the Service, or circumvent its security or access controls.
- Do not use the Service to build a competing product or to train machine-learning models on data you do not own.
Clinical disclaimer
Pebble’s screening and report-drafting features are decision-support tools only. Screening is a sorting tool and does not constitute, and is not a substitute for, a diagnosis. AI-generated content is a starting point produced from intake data; the diagnostician’s professional clinical judgment governs every assessment decision and every final report.
Your content and data
You retain all rights in the data you enter ("Your Content"). You grant us a limited licence to host and process Your Content solely to provide and secure the Service. You are responsible for having the legal basis and consents required to enter Your Content, including any personal data of students or third parties. Our handling of personal data is described in our Privacy Policy.
Intellectual property
The Service, including its software, design, clinical templates, and content (excluding Your Content), is owned by Pebble or its licensors and is protected by law. We grant you a non-exclusive, non-transferable right to use the Service during your subscription. No other rights are granted.
Fees and billing
Paid features are sold as credit packs and are billed through our payment provider. Prices, taxes (including Israeli VAT where applicable), and pack terms are shown at the point of purchase. Except where required by law, payments are non-refundable once credits are consumed.
Third-party services
The Service relies on third-party providers (for example, cloud hosting, an AI model provider, and a payment processor). Your use of the Service may be subject to those providers’ terms. We are not responsible for third-party services we do not control.
Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose, and do not warrant that the Service will be uninterrupted or error-free.
Limitation of liability
To the maximum extent permitted by law, Pebble will not be liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill. Our total liability for any claim relating to the Service will not exceed the amounts you paid us for the Service in the twelve months before the claim.
Indemnification
You agree to indemnify Pebble against claims arising from Your Content or from your use of the Service in breach of these Terms or of applicable law.
Term and termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms. On termination, the licences granted here end; provisions that by their nature should survive (for example, intellectual property, disclaimers, and limitation of liability) will survive.
Changes
We may update these Terms from time to time. Material changes will be reflected by the "last updated" date and, where appropriate, by additional notice. Continued use after changes take effect constitutes acceptance.
Governing law
These Terms are governed by the laws of the State of Israel, and the competent courts of Tel Aviv-Jaffa have exclusive jurisdiction, without regard to conflict-of-laws rules.
